## MADDE 2: KONU

Bu sözleşmenin konusu, ALICI'nın SATICI'ya ait www.theglows.com.tr internet sitesi üzerinden elektronik ortamda sipariş ettiği aşağıda nitelikleri ve satış fiyatı belirtilen ürünün satışı ve teslimi ile tarafların bu konudaki hak ve yükümlülüklerinin belirlenmesidir.

## MADDE 4: GENEL HÜKÜMLER

4.1 ALICI, sözleşme konusu ürünün temel niteliklerini, satış fiyatını, ödeme şeklini ve teslimat bilgilerini okuduğunu ve bilgi sahibi olduğunu ve gerekli teyidi elektronik ortamda verdiğini kabul eder.

4.2 SATICI, sözleşme konusu ürünü, talep edilen niteliklere uygun olarak, garanti belgeleri, kullanım kılavuzları ve varsa yasal gerekliliklere uygun olarak eksiksiz olarak ALICI tarafından belirtilen teslimat adresine teslim etmekle yükümlüdür.

4.3 Sözleşme konusu ürün, ALICI'nın ikametgahının uzaklığına bağlı olarak SATICI tarafından taahhüt edilen süre içerisinde ALICI'ya veya belirtilen adresteki kişi/kuruluşa teslim edilecektir.

4.4 SATICI, sözleşmeden doğan yükümlülüklerini tam ve eksiksiz olarak yerine getirecektir.

## MADDE 5: CAYMA HAKKI

5.1 ALICI, sözleşme konusu ürünü teslim aldığı tarihten itibaren 7 (yedi) gün içinde hiçbir hukuki ve cezai sorumluluk üstlenmeksizin ve herhangi bir gerekçe göstermeksizin sözleşmeden cayma hakkına sahiptir.

## MADDE 6: YETKİLİ MAHKEME

Bu sözleşmeden doğan uyuşmazlıklarda İSTANBUL mahkemeleri ve icra daireleri yetkilidir.

## MADDE 7: YETKİLİ MAHKEME

Mesafeli sözleşmelerde cayma hakkı hangi hallerde kullanılamaz?
Cayma hakkının kullanılamayacağı mal ve hizmetlerin başlıca örnekleri aşağıda listelenmiştir:

Altın ve mücevher gibi fiyatı piyasadaki dalgalanmalara bağlı olarak değişen ve satıcının kontrolünde olmayan mallar,
Özel istek ve ihtiyaçlar doğrultusunda hazırlanan mallar,
Çiçek ve pasta gibi çabuk bozulan veya son kullanma tarihi geçen mallar,
Ambalaj, bant, mühür, paket gibi koruyucu unsurları açılmış olması şartıyla; iç çamaşırı, küpe gibi sağlık ve hijyen açısından uygun olmayan mallar,
CD, DVD gibi dijital içerikli mallar, toner, kartuş ve kitap gibi bilgisayar sarf malzemeleri, ambalaj, bant, mühür, paket gibi koruyucu unsurların malın tesliminden sonra açılmış olması kaydıyla
Abonelik sözleşmesi kapsamında sağlananlar hariç olmak üzere gazete ve dergi gibi süreli yayınlar,
Belirli bir tarihte veya dönemde yapılması gereken otel rezervasyonu, eşya taşımacılığı, araç kiralama, yiyecek-içecek temini ve nişan ve düğün organizasyonu gibi eğlence veya dinlenme amaçlı boş zaman kullanımına ilişkin sözleşmeler,
Uzaktan eğitim gibi elektronik ortamda anında ifa edilen hizmetler,
Müzik, film, bilgisayara veya telefona indirilen programlar gibi anında size teslim edilen maddi olmayan mallara ilişkin sözleşmeler,
Cayma hakkı süresi dolmadan önce tüketicinin onayı ile ifasına başlanan hizmetlere ilişkin sözleşmeler

## MADDE 8: YETKİLİ MAHKEME

Ürünler (parfüm, Teslimattan sonra ambalaj, bant, mühür, paket gibi koruyucu unsurları açılmış ve iadesi sağlık ve hijyen açısından uygun olmayan iç çamaşırı, mayo, kozmetik, kozmetik ürünleri, kulaklık, epilatör, tıraş makinesi vb.) yasal düzenlemeler nedeniyle iade edilemez.

## ARTICLE 2: SUBJECT

The subject of this contract is the sale and delivery of the product with the qualities and sale price specified below, which the BUYER has ordered electronically via the website www.theglows.com.tr owned by the SELLER, and the determination of the rights and obligations of the parties related to this.

## ARTICLE 4: GENERAL PROVISIONS

4.1 The BUYER acknowledges that they have read and are informed about the basic qualities, sale price, payment method, and delivery information of the product subject to the contract and that they have given the necessary confirmation electronically.

4.2 The SELLER is obliged to deliver the product subject to the contract to the delivery address specified by the BUYER, in full, in accordance with the requested qualities, along with warranty documents, user manuals, and in compliance with legal requirements, if any.

4.3 The product subject to the contract will be delivered by the SELLER within the promised period depending on the distance of the BUYER's place of residence, to the BUYER or the person/organization at the address indicated.

4.4 The SELLER will fully and completely fulfill the obligations arising from the contract.

## ARTICLE 5: RIGHT OF WITHDRAWAL

5.1 The BUYER has the right to withdraw from the contract within 7 (seven) days from the date of receiving the product subject to the contract, without assuming any legal and penal responsibility and without stating any reason.

## ARTICLE 6: AUTHORIZED COURT

In case of disputes arising from this contract, the courts and execution offices of İSTANBUL are authorized.

## ARTICLE 7: AUTHORIZED COURT

In which cases cannot the right of withdrawal be exercised in distance contracts?
The main examples of goods and services for which the right of withdrawal cannot be exercised are listed below:

Goods such as gold and jewelry, the price of which varies depending on the fluctuations in the market and which are not under the control of the seller,
Goods prepared in line with special requests and needs,
Perishable or expired goods such as flowers and cakes,
Provided that the protective elements such as packaging, tape, seal, package have been opened; goods such as underwear, earrings that are not suitable for health and hygiene,
Goods with digital content such as CDs, DVDs, computer consumables such as toner, cartridges and books, provided that the protective elements such as packaging, tape, seal, package have been opened after the delivery of the goods
Periodicals such as newspapers and magazines, except those provided under a subscription agreement,
Contracts for the use of leisure time for entertainment or recreation purposes, such as accommodation such as hotel reservations, transportation of goods, car rental, food and beverage supply and engagement and wedding organization, which must be made on a specific date or period,
Services that are instantly performed electronically, such as distance education,
Contracts for intangible goods that are delivered to you instantly, such as music, movies, programs downloaded to a computer or phone,
Contracts for services whose performance is initiated with the consent of the consumer before the expiration of the right of withdrawal period

## ARTICLE 8: AUTHORIZED COURT

Products (perfume, underwear, swimwear, cosmetics, cosmetics, headphones, epilators, shavers, etc.) whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable in terms of health and hygiene cannot be returned due to legal regulations.
